TERMS AND CONDITIONS:

These terms and conditions apply to the Edmond Public Schools Foundation’s Fundraiser (“fundraising events including drawings, raffles, auctions” or “fundraising events”) being conducted by Edmond Public Schools Foundation using any online  platform or service or in person.
In participating in any of the fundraising events, you agree to be bound by these terms and conditions and the terms and conditions of each fundraising item set out below. If you do not accept these terms and conditions, you must refrain from participating in the event.  By checking in to the event through digitally or in person, you are accepting these terms and conditions as a participant or volunteer.

REGISTRATION

In order to participate in any of the fundraising events, you must become a registered user.
To become a registered user, you must complete your registration details in the manner described on ClickBid or any other digital or displayed signage and comply with the terms and conditions of use of that website.  By attending the event, you are considered a registered user.  

Any registered user is entitled to participate in a fundraising event as a bidder. You agree to be bound by the terms of the process as set out in ClickBid’s or any other digital website.  Persons under the age of 18 years are not permitted to register or otherwise participate in any fundraising acitivites. All bidders must register themselves and receive an individual bidder number to participate in fundraising activities.  Each bidder will set a password of their choosing and should not be shared with others.

FUNDRAISING EVENTS

All bidders must submit bids for themselves and not on behalf of any other individual or bidder.
By placing a bid on or offering to buy any good or raffle ticket, you irrevocably agree to pay the total purchase price for the item if you are the successful bidder.  Once you place a bid or offer, you may not cancel it.  Each successful bid or offer creates a winning obligation on you, as bidder, enforceable by each of ClickBid and Edmond Public Schools Foundation and promptly all sums due and perform any other conditions of completion concerning the applicable sale.  
By placing a bid, in any capacity, you signify that you have examined the items as fully as you desire and have had the opportunity to ask questions and receive answers from Edmond Public Schools Foundation that you deem adequate.
For auction items, incremental bids that don’t meet the minimum incremental bid amount are invalid bids and will not be accepted.
If a “Buy It Now” amount is listed, a bidder may bid that amount and purchase the item immediately.  In that case, that item may be closed earlier than the regularly published time.
All auction items will be sold only at or above the minimum asking bid and proceeds will go to Edmond Public Schools Foundation.
Edmond Public Schools Foundation reserves the right to add or withdraw items, without notice, to or from the auction or other fundraising events.
Each person participating in fundraising events and/or auctions assumes all risks and hazards related to the fundraising events and items obtained. Each bidder agrees to hold harmless from any liability arising indirectly from Edmond Public Schools Foundation, their elected and appointed officials, members and employees, the auction company and its agents and employees, the event organizers, sponsors, and/or volunteers connected with Edmond Public Schools Foundation.


FUNDRAISING EVENT WINNERS

The highest bid will be deemed to be the winner unless a bidder uses the “Buy It Now” function. In the extreme case of where an entry error has occurred, please contact us for the retraction of your bid. If this occurs we reserve the right to offer the item to the second highest bidder.
The decision of the winners is that of Edmond Public Schools Foundation and its team, and all decisions will be final.


PAYMENT

Payment for items purchased must be made in full to Edmond Public Schools Foundation by the end of the event. All payments must be made via ClickBid unless arrangements prior to the event have been made.  ClickBid accepts various forms and methods of payment which may or may not vary depending on the device being used.   Any items not paid for by the end of the event may be offered to the next bidder.


DONATIONS

All donations to Edmond Public Schools Foundation made via ClickBid or the ClickBid service “text to give” are binding and final. A donation receipt will be provided for your records through the ClickBid database.    Donations for general Fund A Need will be used to support all of the programs and operations to implement said programs.


TERMS OF SALE

All sales are final. There will be no exchanges or refunds.
Edmond Public Schools Foundation does not make any expressed or implied warranties or guarantees on fundraising event items regarding quality or value of items or services. Edmond Public Schools Foundation attempted to describe and catalog all items correctly, but all items are offered and sold “AS IS” and “WITH ALL FAULTS.” Edmond Public Schools Foundation neither warrants nor represents, and in no event shall be responsible for the correctness of descriptions, genuineness, authorship, provenance or condition of the items. No statement made shall be deemed such a warranty, representation, or assumption of liability.
By the buyer’s purchase, the buyer waives any claim for liability against Edmond Public Schools Foundation, its elected and appointed officials, members and employees, sponsors, volunteers connected with the fundraising event, and/or the donor of the item. Neither Edmond Public Schools Foundation nor the donor is responsible for any personal injuries or damage that may result from the use of the goods, property, or services.
Items have not been appraised unless so noted. The amount you pay above the fair market value estimate is normally tax deductible as a charitable contribution. Please consult your tax adviser to clarify the amount of deduction.
All items have been donated kindly by the respective parties and as such any respective terms and conditions are applicable.
Reservations for accommodations must be mutually arranged with the donor unless otherwise noted. Please note any restrictions for dates or travel before bidding.  
Restaurant certificates/coupons do not include alcohol, tax, or gratuities unless specified.
Unless otherwise agreed by Edmond Public Schools Foundation, items will not be released to the winning bidder until payment and/or cleared funds have been received.
Once Edmond Public Schools Foundation receives payment, unless otherwise described within this document, we will arrange delivery of the items with the winning bidder.  If the winning bidder lives outside the Edmond, OK area, shipping may be offered unless otherwise noted in the item description.  Winning bidders shall be responsible for all shipping charges, which will be invoiced separately.  All shipping charges must be paid in full before the item(s) is shipped.  Shipping may include, but is not limited to: a carrier selection of Edmond Public Schools Foundation’s choice and may or may not include tracking, insurance, and/or signature confirmation.  Edmond Public Schools Foundation will contact the winning bidder for verification of preferred shipping address.  Edmond Public Schools Foundation, their elected and appointed officials, members and employees, sponsors, and/or volunteers connected with the fundraising event cannot hold any responsibility or liability from items lost or otherwise damaged in shipping.
Any item left unclaimed, without prior arrangements, may be sold and proceeds will go to Edmond Public Schools Foundation or used otherwise for charitable purpose in accordance with the mission of Edmond Public Schools Foundation.


PERSONAL INFORMATION

A participant in these fundraising events authorizes Edmond Public Schools Foundation to collect, use and disclose that person's personal information for the purpose of participating in the fundraising events or further communication from Edmond Public Schools Foundation.  Any successful participant consents Edmond Public Schools Foundation’s use of their full name, photo, video and other details for any promotional, marketing and publicity purposes in any media worldwide without any fee being paid. Information that Edmond Public Schools Foundation is required to collect by law for the conduct of this fundraising event and funds raised as a result will be retained as required.


DISCLAIMERS

Each person bidding assumes all risks and hazards related to the fundraising event and items obtained at fundraising events. Each participant/bidder agrees to hold harmless from any liability arising indirectly from Edmond Public Schools Foundation, their elected and appointed officials, members and employees, sponsors, the auction company and its agents and employees, the event organizers, sponsors, and/or volunteers connected with the fundraising event.
Edmond Public Schools Foundation does not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in participating in the fundraising events, use and enjoyment of the items or in connection with your use of ClickBid’s website, nor do we accept any responsibility for any such loss or damage arising out of your use of, or reliance on, information contained on, or accessed through, ClickBid’s website.  
Edmond Public Schools Foundation offers no warranties in relation to goods or services sold or listed pursuant to the fundraising event process. We also offer no warranty in relation to the availability of the ClickBid service.   You release and indemnify us against all actions, claims and demands (including the cost of defending or settling any action, claim or demand) which may be instituted against us arising out of a failure by you to comply with these terms and conditions or a failure by the other party to a transaction to complete a sale or satisfy the requirements of a sale.
You acknowledge that we make no representation as to the ownership of title in fundraising event goods which are not goods owned by us.  To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded.


DISQUALIFICATION AND CANCELLATION

If the Edmond Public Schools Foundation forms a reasonable view that any bid or the fundraising event process for any participant has been tampered with or otherwise does not comply with these Terms and Conditions, Edmond Public Schools Foundation reserves the right to disqualify that participant at its sole discretion.
If for any reason Edmond Public Schools Foundation determines in good faith and at its sole discretion that the fundraising event is not capable of running as planned due to any agent or event beyond the reasonable control of Edmond Public Schools Foundation which might corrupt or affect the administration, security, fairness, integrity or proper conduct of the fundraising events or which may change the intended result or prevent or hinder its determination, Edmond Public Schools Foundation, at its sole discretion (subject to any directions or necessary approvals from the relevant authorities) vary, postpone, suspend or cancel the fundraising events at any time. In the event of cancellation Edmond Public Schools Foundation will use its best endeavors to recommence the fundraising on similar terms and conditions if, at its sole discretion, it is feasible to do so.

EVENT LIABILITY

The following statements pertain to volunteers and attendee.  All attending understand they are doing so as their own personal choice.

Edmond Public Schools Foundation (“Corporation”). is a non-profit organization with a mission to connect the community and its resources with the Edmond Public Schools teacher, student, and school needs in pursuit of the highest level of academic excellence. The Corporation regularly engages volunteers in its activities. In consideration for my ability to participate in Corporation activities.

Policies and Safety Rules
For my safety and that of others, I will comply with the Corporation’s  policies and safety rules and its other directions for all activities.

Awareness and Assumption of Risk
I understand that my activities may have inherent risks that may arise from the Corporation’s activities themselves, operations, my own actions or inactions, or the actions or inactions of directors, officers, employees, contract employees, other volunteers, and others present at Corporation events. These risks may include, but are not limited to, working in situations working at event venues, lifting objects, and performing repetitive tasks. I assume full responsibility for any and all risks of bodily injury, death or property damage caused by or arising directly or indirectly from my presence or participation at Corporation events or participation in Corporation activities, regardless of the cause.

Waiver and Release of Claims
I waive and release any and all claims against the Corporation its directors, officers, employees, contract employees, and volunteers (associates), for any liability, loss, damages, claims, expenses and attorney’s fees (or attorneys’ fees) resulting from death, or injury to my person or property, caused by or arising directly or indirectly from my presence at Corporation events, or participation in activities on behalf of the Corporation, regardless of the cause and even if caused by negligence, whether passive or active. I agree not to sue any of the Released Parties on the basis of these waived and released claims. I understand that the Corporation would only permit me to volunteer with my agreement to these waivers and releases.

Medical Care Consent and Waiver
I authorize the Corporation to provide to me with medical personnel of its choice to provide medical assistance, transportation, and emergency medical services. This consent does not impose a duty upon the Corporation to provide such medical assistance, transportation, or emergency medical services. Additionally, I waive and release any claims against the associates arising out of any treatment, or medical service, including the lack or timing of such, made in connection with my activities with the Corporation.

Indemnification
I will defend, indemnify, and hold all associates harmless from and against any and all loss, damages, claims, expenses, and attorney’s fees (or attorneys’ fees) that may be suffered by any associate resulting directly or indirectly from my  activities for and with the Corporation, except and only to the extent the liability is caused by the gross negligence or willful misconduct of the relevant associate.
